This Privacy Policy sets out how Lean In Energy, Inc., a Texas non-profit corporation  (“the Organization”) may collect and use information from its customers and other individuals (collectively “you”) who access the Organization's websites, its mobile applications, or any other of the Organization's products or services that reference this Privacy Notice (collectively “the Services”).

1. PRIVACY POLICY

This Privacy Policy details how the Organization collects, uses and processes your information. You should read this entire Privacy Policy before submitting information to the Organization or using any Services. If you or your organization has negotiated an agreement with the Organization, that agreement may have distinct privacy terms which will take precedence over this Privacy Policy.

If this Privacy Policy changes, the revised policy will be posted on this website. If the Organization makes any material changes to this Privacy Policy, the Organization may notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this website. The Organization's customers may receive change notifications directly from their administrators.

The Services may include links or references to other websites, services, materials, or entities (collectively “Third-Party Sites”). This Privacy Policy does not apply to Third-Party Sites unless otherwise indicated. Third-Party Sites are subject to their own privacy policies and customers are encouraged to review such policies prior to use of any Third-Party Sites.

2. INFORMATION THE ORGANIZATION COLLECTS

The Organization collects information from you solely as described in this Privacy Policy. The Organization may collect information from you both online and offline. We may combine information collected from these disparate sources unless we tell you otherwise. The Organization collects three general categories of information from you:

2.1 Information you provide directly to the Organization when you use the Services, including:

  • Contact information, including name, title, street address (home, work), postal code, country, telephone numbers (home, work, cell, etc.), email address (home, work), company name, and other similar information;
  • Personal/demographic information (ie gender, level of education, etc.);
  • User content (information provided when you use online means of communication (such as chat features) and all other user submissions and content you provide); and
  • Any other information collected directly from you through a transaction or inquiry, or your submission of a form, registration, or communication to the Organization.

2.2 Information automatically collected from your use of the Services, including:

As you use the Services, some information can be “passively” collected using various technologies, such as cookies, web beacons, and navigational data collection (clickstream, log files, server logs, etc.). Your Internet browser automatically transmits some of this information. Such technologies keep track of your interactions with the Services and provide you with a more customized experience.
  • Your activities while on the Organization-controlled websites;
  • the URL of the website you just visited; and
  • the Internet Protocol (IP) address and browser version currently being used by your computer.

2.3 Information collected from third party sources, including:

The Organization may collect information about you, including your name, employer, job title, and contact information from various third-parties. Third-party sources may include opt-in lists, publicly available data, consumer reporting agencies, webinar or video hosting services or other companies. If applicable and so requested by your company, the Organization may also collect information about you from your company’s administrators or HR systems.

The Organization respects your privacy and will only collect such information from third-parties in accordance with applicable law.

3. HOW THE ORGANIZATION USES YOUR INFORMATION

3.1 General.

The Organization uses the information we collect about you for a wide range of purposes, including:
  • to communicate with you (including promotional communications) and to respond to your requests (including requests for newsletter subscriptions, materials, support etc.);
  • to process your transactions and to provide and contact you about products or services that you have ordered;
  • to invite and help you participate in online and offline events;
  • to allow you to use the Services (including allowing you to contact another person or post information and other content online);
  • for analytical purposes and to improve products, services, and websites;
  • for marketing and research purposes;
  • for internal and/or external training, quality assurance, and other purposes (including without limitation, call center recordings);
  • for legal reasons;
  • and as otherwise specified in this Privacy Policy and/or at the point of personal data collection.
The Organization may combine information about you that is collected from disparate sources. As permitted by applicable law, the Organization may make full use of all information that is de-identified or otherwise not in personally identifiable form, including without limitation, user-generated content.

3.2 Cookie and Web Beacon Use

The Organization may use the information collected from cookies and related technologies for the purposes identified above, as well as to analyze trends, administer the website, track users’ movements, gather broad demographic information for aggregate use and to confirm that a particular individual affirmed his/her consent to specific legal terms (e.g. a clickwrap license agreement).

4. WHEN THE ORGANIZATION SHARES AND DISCLOSES YOUR INFORMATION

The Organization will share your information with third-parties solely as permitted by law and only in the ways that are described in this Privacy Policy or as otherwise set forth in a negotiated agreement between the Organization and you (or your company). The Organization does not sell your information to third parties. Any third-parties that the Organization may share your information with are obliged to keep your information secure and in accordance with this Privacy Policy.

4.1 Disclosure to Affiliates and Third-Parties to Support the Services.

The Organization may disclose information you provide to the Organization's affiliates and partners and to consultants, service providers, and contractors that the Organization uses to support business and operations (e.g., delivery services, financial institutions, fulfillment services, technical support, advertising, public relations, media and marketing services, legal services, call-in centers, e-commerce and other web-related services such as web hosting and web monitoring services, and event-related services such as online and offline data capture services). In all cases, the Organization will only disclose to such persons who have agreed to keep the information confidential and use it only to provide the applicable service(s).

4.2 Compelled Disclosure.

The Organization may also disclose information to governmental agencies and other third parties:
  • If required to do so by law, regulation, or court order;
  • to respond to governmental and/or law enforcement requests;
  • to identify, contact, or bring legal action against someone who may be causing injury to or interfering with the Organization's (or others’) rights or property;
  • to support any claim, defense, or declaration in a case or before any jurisdictional and/or administrative authority, arbitration, or mediation panel;
  • or in connection with disciplinary actions/investigations.

4.3 Disclosure in the Event of a Sale or Assignment.

The Organization may disclose your information to third parties in connection with the sale, assignment, or other transfer of the Organization, its business or the website to which such information applies. In the event that the Organization goes through a business transition, such as a merger, acquisition by another company or sale of a portion of its assets, your information may be part of the assets transferred. You will be notified via prominent notice on the Services prior to a change of ownership or control of your information. If, as a result of the business transaction, your information will be used in a manner materially different from that stated at the time of collection, you will be notified consistent with this Privacy Policy.

5. PROCESSING OF PERSONAL DATA UNDER EUROPEAN DATA LAW

Where the Organization is acting as a data controller under European Data Laws, the Organization processes your personal data only: (i) where the Organization has collected your consent to do so; (ii) where the Organization needs the information to perform a contract with you; or (iii) where the processing is in the Organization’s legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms.  Specifically, when the Organization:
  • uses information to create or manage an account, the Organization needs it in order to provide relevant services;
  • uses contact information for marketing purposes, the Organization does so with your consent (which you can revoke at any time).
  • gathers usage data and analyzes it to improve the Services, the Organization does so based on the Organization’s legitimate interest in safeguarding and improving the Services.
For the sake of clarity, where the Organization is processing (including but not limited to collecting or sharing) your information based on the legal basis of consent, the Organization will seek consent from you independently of this Privacy Policy. You can withdraw such consent at any time by contacting the Organization using the contact information provided in the “Contact the Organization” section below.

The Organization may also process your personal data in its role as a data processor for your company. In such cases, your company is acting as the data controller and the Organization is processing data on its instructions.

6. PREFERENCES AND DATA SUBJECT RIGHTS

You can unsubscribe from all email marketing messages the Organization sends you by contacting the Organization as specified in the “Contact the Organization” section below, or by following the unsubscribe instructions in various communications that the Organization may send you. the Organization customers may contact their administrators for assistance changing their preferences.

Keep in mind that these preferences regarding promotional contacts do not mean that the Organization might not contact you for other reasons, such as those related to an order you placed, an inquiry you made, a membership you undertook, an event for which you registered, a legally required notice, and so on.

Based on your location, you may have additional rights under applicable law, such as:
  • the right to access and review information associated with your use of the Services at any time. You also can request the following information: how the Organization collects and uses your information and why; the categories of personal data involved; the categories of recipients of your personal data; how the Organization received your personal data; and how long the Organization uses or stores your personal data or the manner in which the Organization determines relevant retention periods;
  • the right to correct your personal data;
  • the right to request that the Organization erase or stop processing your personal;
  • the right to export your personal data;
  • the right to raise questions or complaints with your local data protection authority at any time.

7. SECURITY AND DATA RETENTION

The Organization follows generally accepted industry standards to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction, whether in transmission or storage. In particular, information at rest is protected using AES 256 encryption and the Organization employs controlled interfaces (such as proxies, gateways, routers, firewall, and encrypted tunnels) as well as a variety of additional security controls (e.g., intrusion detection systems, data encryption). All communications within the the Organization Mentor Service are secured via a high-grade 256-bit SSL encryption. Where required by applicable law, the Organization will keep your information for no longer than necessary for the purposes for which it is processed. For information stored in a customer account, the Organization will retain such information for as long as the applicable account is active. After termination of the account, information is generally retained for ninety (90) days. Where there are technical limitations that prevent deletion or anonymization, the Organization will safeguard and limit the use of information as required by applicable law.

8. TRANSFER OF INFORMATION OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

The Organization may process your information in the U.S. or any other countries in which the Organization has a presence or data processing facilities. Similarly, the Organization may transfer information from the EEA to the United States or another country outside the EEA.

The Organization will comply with all applicable law relating to the processing and transfer of personal data outside the EEA. Where applicable law requires consent for such international processing or transfer, the Organization will seek consent from you independently of this Privacy Policy.

For the avoidance of doubt, where you (or your company) have entered into separate terms with the Organization regarding the international processing or transfer of personal data, those terms will govern and take precedence over this Privacy Policy.

9. COPPA REQUIREMENTS

The Services are not directed to children and the Organization does not knowingly collect any information from children under 13 years of age through the sites.

Chronus LLC and its affiliates (“we” or “our”) partner with companies and organizations (collectively “Organizations”) to provide mentoring software on the Chronus mentoring platform (the “Services”) to individual users (“you”) at the instruction of their Organizations.
At Chronus, we value your privacy. This Privacy Notice (“Notice”) sets out how your personal information may be collected or used by us in order to provide the Services. We recognize that privacy is an ongoing responsibility, and as such, we may update this Notice from time to time as we undertake new privacy practices.
The Services may include links, integrations or references to non-Chronus websites, services, materials, or entities (collectively “Third-Party Services”). This Privacy Notice does not apply to Third-Party Services. Third-Party Services are subject to their own privacy policies and you are encouraged to review such policies prior to use of any Third-Party Services.
Role of Chronus: With respect to the Services, Chronus is a “data processor” or “service provider” under applicable privacy laws. This means that when you use our Services, we are processing (using) your personal information at the instruction of your Organization, who determines the means and purposes of processing your personal information as the “data controller” or “business”. This Notice sets out our standard privacy practices for the Services. As the “data controller”, your Organization may instruct us to treat your personal information differently than described in this general Notice. How we Process your Personal Information: We collect your personal information from your Organization or directly from you. In order to provide the Services to you, we generally collect personal identifiers (such as your name, email and IP address) along with any additional personal information requested by your Organization or voluntarily provided by you or your Organization. We may also “passively” collect your personal information using various technologies, such as cookies, web beacons, and navigational data collection (clickstream, log files, server logs, etc.). We will only process your personal information for the purposes of providing you with the Services (including for the purposes of building, improving and securing our Services), or as otherwise instructed by you, your Organization or as required by applicable law.
We do not sell your personal information to anyone and only share it with those third parties who are facilitating the provision and support of the Services on our behalf (“subprocessor(s)”) or as otherwise requested by you. We require our subprocessors to comply with all laws applicable to the security and processing of your personal information. We may also disclose your personal information to governmental agencies and other third parties when required to do so by law. Unless otherwise instructed by your Organization, we (including our subprocessors) may process your personal information globally. Similarly, we (including our subprocessors) may transfer your personal information from the EEA to another country outside the EEA. We will comply with all applicable law relating to the processing and international transfer of personal information.
Security and Data Retention: To help protect the privacy of your personal information, we maintain appropriate and industry standard physical, technical and administrative safeguards. We update and test our security technology on an ongoing basis. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your personal information. Where required by applicable law, we keep your personal information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain your personal information depends on the purposes for which we collected and used your personal information and/or the laws applicable to your personal information.
COPPA Requirements: We do not direct or knowingly advertise the Services to individuals under the age of thirteen.
Data Subject Requests, Questions and Complaints: You may have additional “data subject rights” under applicable laws (such rights may include, but are not limited to, the right to access and rectify your personal information, the right to request additional details about how we use your information, the right to request that we delete, make portable or stop processing your personal information, the right to contact your data protection supervisory authority and the right not to receive discriminatory treatment from us based on your election to to exercise your applicable data subject rights).
